1. The Nature of Our Service

Monrq provides a software platform designed to facilitate group coordination, logistics, and planning. We provide the digital infrastructure to remove the friction of organizing travel and group experiences.

Please note that Monrq is strictly a technology platform. We are not a travel agency, a transportation provider, a hospitality vendor, or a financial institution. Any bookings, accommodations, or third-party services coordinated through our platform are direct agreements between you and the respective third-party vendors.

Monrq assumes no liability for the performance, cancellations, or errors of any third-party services, vendors, or external payment processors.

2. Eligibility and Age Requirements

To access or use Monrq, it is required that you are at least 18 years of age, or the legal age of majority in your jurisdiction. The platform is not intended for, nor directed at, minors.

By creating an account and utilizing our coordination tools, you represent and warrant that you meet this age requirement and possess the legal authority to enter into a binding contract. If we become aware that an account has been created or operated by an individual under the required age, we reserve the right to immediately terminate the account and delete any associated data.

3. Account Security and User Obligations

To access the coordination features of Monrq, you agree to register for an account and provide accurate, current, and complete information during the process. The confidentiality of your login credentials is solely your responsibility.

Any activity, planning, or communication that occurs under your account will be considered authorized by you. If you suspect any unauthorized access or breach of security regarding your account, you agree to notify our support team immediately.

4. Payments and Financial Passthrough

Monrq operates strictly as a coordination engine. We provide the software logic to help groups organize financial commitments, but Monrq is not a bank, an escrow service, or a payment processor.

All monetary transactions facilitated through the platform are processed by independent, third-party financial institutions or payment gateways. Because Monrq does not hold, control, or directly transmit your funds, the platform is not liable for any failed transactions, billing disputes, chargebacks, or processing delays.

Any request for refunds regarding third-party travel services, accommodations, or vendor bookings should be directed to the specific vendor or the third-party payment processor. Your use of any integrated payment tools is subject to the independent terms and conditions of those respective financial providers.

5. User Conduct and Platform Abuse

Monrq is built to facilitate seamless group coordination. To maintain the integrity of the platform, accounts are expected to engage with our services for lawful, transparent, and collaborative purposes only.

The following activities are strictly prohibited on the platform:

  • Engaging in any conduct that violates applicable local, state, national, or international law.
  • Harassing, threatening, or defrauding other users, group members, or third-party vendors.
  • Attempting to bypass, exploit, or reverse-engineer the platform’s software logic, infrastructure, or security measures.
  • Deploying automated systems, bots, or scrapers to extract data from Monrq.
  • Transmitting viruses, malware, or any destructive code through our systems.

Monrq retains the right to investigate any suspected violations of these boundaries. If it is determined, at our sole discretion, that an account is engaged in abusive or prohibited behavior, we reserve the right to suspend or permanently terminate access to the platform without prior notice.

6. Intellectual Property and Platform Ownership

The Monrq platform, including its original codebase, interface logic, visual architecture, branding, and proprietary phrasing such as "The Calm. The Choice." and "The One Place," are the exclusive property of Monrq and its holding entities.

These assets are fully protected by copyright, trademark, and other applicable intellectual property laws. By utilizing the platform, users receive a limited, non-exclusive license to access the coordination infrastructure for its intended purpose. This access grants no ownership rights over the software itself.

Users agree to refrain from copying, modifying, reverse-engineering, or distributing any core structural elements of the platform. Any text, schedules, or custom planning data submitted by a user into their coordination groups remains the property of that user. To ensure the software operates effectively, submitting this data grants Monrq a necessary, standard license to host, display, and route that information solely within the intended environment of the applicable group.

7. Service Availability and Limitation of Liability

Monrq is provided on an "as-is" and "as-available" foundation. While we are committed to maintaining a highly secure and uninterrupted digital infrastructure, we cannot guarantee that the platform will operate completely free of errors, delays, or external disruptions.

To the fullest extent permitted by applicable law, Monrq and its holding entities will not be held liable for any indirect, incidental, or consequential damages arising from your use of the platform. This includes, but is not limited to, loss of data, communication failures, or missed itineraries caused by software downtime.

The stability of our ecosystem is our priority, but engagement with the coordination tools is conducted at your own discretion.

8. Governing Law and Dispute Resolution

These Terms of Service, and any disputes arising from your use of the platform, will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

To ensure the efficient and private resolution of any disagreements, any claim or dispute arising out of or relating to these Terms or the Monrq platform shall be settled exclusively by binding arbitration, rather than in civil court. By agreeing to these Terms, you expressly waive the right to participate in a class-action lawsuit or any class-wide arbitration against Monrq or its holding entities.

9. Modifications to the Terms

As the Monrq ecosystem evolves, we may periodically refine and update these Terms of Service. Should material changes be made to the structural agreement, we will notify you via the email address associated with your account or through a prominent notice within the interface. Continued engagement with the platform following any modifications constitutes your acknowledgment and agreement to the revised Terms.
